A Note Before This Goes Anywhere
This is a general-use template, not legal advice. Same as the coaching agreement, waiver, and privacy policy, have this reviewed by a licensed attorney before treating it as final, especially the digital product and liability sections below, since refund law and liability limitations vary by state.
Agreement to Terms
By using drakesathleticsclub.com or purchasing anything through it, you agree to these Terms of Service. If you don’t agree, don’t use the site or make a purchase.
Who This Site Is For
This site and its products are intended for adults 18 or older. By using the site or purchasing a product, you confirm you meet that requirement.
Use of the Website
You agree to use this site only for lawful purposes. You won’t:
• Attempt to copy, scrape, resell, or redistribute the site’s content, guides, or design
• Attempt to interfere with the site’s security or normal operation
• Use the site to harass, impersonate, or misrepresent yourself to Drake’s Athletics or other users
Intellectual Property
All content on this site, including training guides, written content, branding, logos, and design, is the property of Drake’s Athletics unless otherwise noted. You may view and use it for your own personal, non-commercial purposes. You may not reproduce, distribute, or publish it elsewhere without written permission.
Digital Products (Pre-Built Training Plans)
This section covers training plans and other digital products purchased through the site, separate from 1:1 coaching (covered below).
License, Not Ownership
When you purchase a training plan or other digital product, you’re buying a personal-use license, not the file itself. This means:
• The plan is for your own individual use only
• You may not share, resell, forward, or publicly post the plan or any part of it
• Drake’s Athletics retains all rights to the content
All Sales Are Final
Digital products are non-refundable once purchased and delivered, since access can’t be “returned” the way a physical product can. If something goes wrong with delivery or you received the wrong file, contact us at contact@drakesathleticsclub.com and we’ll make it right.
These Are Not Personalized Coaching
A pre-built training plan is a general program, not a plan built around your individual health history, current fitness, injuries, or schedule the way 1:1 coaching is. It has not been reviewed by a coach specifically for you. Before starting any training plan purchased through this site:
• Consult a physician if you have any underlying health condition, are pregnant, are returning from injury, or are new to exercise
• Stop immediately and seek medical attention if you experience pain, dizziness, chest pain, or other concerning symptoms during training
• Use your own judgment about pacing, load, and rest, a generic plan cannot account for how you’re feeling on a given day the way a coach adjusting your plan in real time can
Drake’s Athletics makes no guarantee of results, race times, or outcomes from following a pre-built plan, and is not liable for injury resulting from use of a plan purchased through the site, to the fullest extent permitted by law.
1:1 Coaching
1:1 coaching is governed separately by the Coaching Agreement and Medical Release & Liability Waiver signed directly with Drake’s Athletics before coaching begins, not by this document. If you’re a coaching client, those documents take precedence over this section for anything related to your coaching relationship.
Payment Processing
Purchases are processed through third-party providers (including Checkout Page and Stripe). Drake’s Athletics is not responsible for outages, errors, or issues caused by these third-party services, though we’ll do what we reasonably can to help resolve any payment issue you run into.
Limitation of Liability
To the fullest extent permitted by law, Drake’s Athletics is not liable for indirect, incidental, or consequential damages arising from your use of the site or its products. Nothing in this section limits liability that can’t legally be limited.
Disclaimer of Warranties
This site and its products are provided “as is,” without warranties of any kind, express or implied, including fitness for a particular purpose.
Changes to These Terms
We may update these Terms as the business grows. The “last updated” date at the top will reflect the most recent revision. Continued use of the site after changes means you accept the updated Terms.
Governing Law
These Terms are governed by the laws of [Insert state], without regard to conflict of law principles.
